European Commission – Urban Wastewater Treatment Directive: final warning for Portugal and court referral for Luxembourg

The European Commission has decided to pursue infringement proceedings against Portugal and Luxembourg because they are failing their duties concerning the Urban Wastewater Treatment Directive (UWTD). These actions are part of a series of environment-related infringement decisions against several Member States, which the Commission is now announcing over a period of days.


Portugal has been sent a final written warning for failure to adequately treat the wastewater discharged from 17 cities and towns of more than 15,000 inhabitants.

Luxembourg received a final warning in an earlier stage and the Commission has now decided to refer Luxembourg to the European Court of Justice (ECJ). Under the UWTD, Luxembourg has designated all the rivers on its territory as sensitive to eutrophication. However, it has not ensured that the wastewater discharged into them meets quality objectives set by the Directive.
